The transferee Court presiding over the Dollar General Motor Oil MDL issued a lengthy opinion largely denying Dollar General's Motion to Dismiss and Motion to Strike Class Allegations. The Casey Law Firm is co-counsel in the case, In re: Dollar General Corp. Motor Oil Marketing and Sales Practices Litig., MDL No. 2709 (W.D. Mo.), which seeks to compensate multiple classes of consumers for their purchase of Dollar General branded motor oil which Plaintiffs allege is harmful to automobiles manufactured after 1988. The MDL alleges violations of twenty states' consumer protection statutes and warranty laws, and further brings nationwide unjust enrichment and warranty claims. In the Motion to Dismiss Order (Docket No. 102), all of the Plaintiffs' claims survived except one state's implied warranty claim. The case is currently ongoing.
